Your use of this Website constitutes your agreement to all such terms, conditions, and notices in effect at such time. We may amend these Terms and Conditions at any time; changes or amendments will be posted at the bottom of this page for public view and be considered effective 30 days from the date such changes take place. 1. INTRODUCTION TO GETTHEJOBDONERIGHT. Upon your registration as either a Homeowner or a Contractor, you may choose your own password or GetTheJobDoneRight will assign you a password to access the GetTheJobDoneRight services through the GetTheJobDoneRight Website. 2. GETTHEJOBDONERIGHT SERVICES. A. SERVICES FOR HOMEOWNERS Upon entering your information and the request for which you would like a Contractor, we will provide you with a list of Contractors in your area, if any, who may be interested in fulfilling your service need. The list will include the name of the Contractor’s business, contact information, and, if the Contractor has subscribed to GetTheJobDoneRight’s services, the Contractor’s profile (if the Contractor has provided this information) and feedback regarding the Contractor. In addition, we will send information relating to your request to Contractors who have subscribed to our services. Any Contractors on the list who have subscribed to our services are allowed to post profiles about themselves and their business. You will be allowed to access such profiles.We do not guarantee that we will be able to match your service needs with a Contractor or that there are Contractors in your area that either are capable or willing to complete your service needs. We make no guarantees or representations regarding the skills or representations of such Contractors or the quality of the job that they may perform for you if you elect to retain their services. GetTheJobDoneRight does not endorse or recommend the services of any particular Contractor. It is entirely up to you to enter into a direct contract or otherwise reach agreement with a Contractor. The Contractors are not employees or agents of GetTheJobDoneRight, nor is GetTheJobDoneRight an agent of the Contractors. GetTheJobDoneRight is not a broker. GetTheJobDoneRight does not perform, and is not responsible for, any of the services requested by you in your service request. Your rights under contracts you enter into with any Contractor are governed by the terms of such contracts and by applicable federal, state and local laws. Should you have a dispute with any Contractor, you must address such dispute with such Contractor. YOU HEREBY AGREE TO RELEASE GETTHEJOBDONERIGHT (AND OUR OFFICERS, DIRECTORS, MEMBERS, SHAREHOLDERS, AFFILIATES, EMPLOYEES AND AGENTS) FROM ANY DAMAGES OR CLAIMS (INCLUDING CONSEQUENTIAL AND INCIDENTAL DAMAGES) OF EVERY KIND OR NATURE, SUSPECTED AND UNSUSPECTED, KNOWN AND UNKNOWN, AND DISCLOSED OR UNDISCLOSED, ARISING OUT OF OR IN ANY WAY CONNECTED WITH SUCH DISPUTES AND YOUR DEALINGS WITH ANY CONTRACTORS Once a job is completed, GetTheJobDoneRight will archive a summary of such job for your future reference. There is no fee for the services provided byGetTheJobDoneRight to a Homeowner. B. SERVICES FOR CONTRACTORS Upon the receipt of a request from a Homeowner residing in your area for the type of services you provide, GetTheJobDoneRight will provide the Homeowner with your name, address and telephone number. In addition, if you subscribe to GetTheJobDoneRight’s services, you will be contacted by GetTheJobDoneRight by e-mail or text message regarding Homeowners who might be interested in your services. GetTheJobDoneRight is not responsible for any charges incurred by you in connection with any such e-mails or text messages. Contractors who subscribe to GetTheJobDoneRight’s services will also be allowed to : (a) post profiles about themselves and their business on the GetTheJobDoneRight Website; (b) include work that they were hired for that is not associated with GetTheJobDoneRight and work that they have already completed before subscribing to GetTheJobDoneRight’s services in their feedback ranking; and (c) add or delete to or from their network at any time other Contractors who have subscribed to GetTheJobDoneRight’s services. Any Homeowner will be allowed to post feedback with respect to any Contractor who subscribes to GetTheJobDoneRight’s services based on work completed by such Contractor for such Homeowner. GetTheJobDoneRight is not liable for the content of any feedback provided by a Homeowner with respect to any Contractor. However, GetTheJobDoneRight reserves the right, in its sole discretion, to delete or decline to publish or otherwise disseminate any feedback which it deems to be inappropriate. In the event a Contractor who subscribes to GetTheJobDoneRight’ services cancels his subscription, feedback from Homeowners regarding work completed by such Contractor for such Homeowners may still appear on GetTheJobDoneRight’s Website, at the sole discretion of GetTheJobDoneRight. Initially, there is no fee for the services provided by GetTheJobDoneRight to Contractors. However, GetTheJobDoneRight reserves the right to implement a fee structure in the future. In the event a fee structure is implemented, a Contractor will be given an opportunity to “opt-in” as a paid subscriber. 3. INFORMATION YOU PROVIDE TO US. A. HOMEOWNERS Upon using the GetTheJobDoneRight services, you will be prompted to disclose certain information about yourself and your service requirements, and you will be able to store information, such as home services records, on our Website. Some of this information will be sent to Contractors who will need this information to respond to you. By providing this information to us, or by submitting a service request, you are requesting, and you expressly consent to being contacted by Contractors via telephone, fax, email, mail or other reasonable means, at any of your contact numbers or addresses, even if you are listed on any federal, state or other applicable "Do Not Call" list. For complete details on our use of your information, please see our privacy statement. By completing a service request, you promise that all information you provide will be accurate, current and truthful to the best of your knowledge. If you provide any information that is untrue, not current or incomplete, or GetTheJobDoneRight has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, GetTheJobDoneRight has the right to refuse any current or future use of the GetTheJobDoneRight services (or any portion thereof) by you. You are responsible for any use of the GetTheJobDoneRight services by persons to whom you intentionally or negligently allow access to your password. B. CONTRACTORS Upon subscribing to GetTheJobDoneRight’s services, you will be prompted to provide certain information about yourself and your business, including name, address, telephone number(s), e-mail address, categories of contracting services which you perform and geographical area(s) in which you perform contracting services. By subscribing to GetTheJobDoneRight’s services, you promise that all information you provide will be accurate, current and truthful to the best of your knowledge. If you provide any information that is untrue, not current or incomplete, or GetTheJobDoneRight has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, GetTheJobDoneRight has the right to refuse any current or future use of the GetTheJobDoneRight services (or any portion thereof) by you. You are responsible for any use of the GetTheJobDoneRight services by persons to whom you intentionally or negligently allow access to your password. 4. YOUR USE OF GETTHEJOBDONERIGHT SERVICES. A. HOMEOWNERS You acknowledge and agree that your use of GetTheJobDoneRight’s services is for your personal use and not for any commercial or advertising purposes. You agree that all of the content and information posted on the GetTheJobDoneRight Website, including, but not limited to, Contractor profiles, screening information, feedback (including any feedback provided by you) and archive summaries of completed jobs, is the sole and exclusive property of GetTheJobDoneRight, and that you have no right to reproduce, post, publish, or otherwise use such information other than for your personal use relating to your service request. You agree to indemnify and hold GetTheJobDoneRight, its officers, directors, members, shareholders, affililiates, employees and agents, harmless from any claims brought against any of them based on or arising from your violation of the foregoing. We reserve the right to revoke your access to the GetTheJobDoneRight Website and services at any time. All information about Contractors is confidential and for your personal use only. If it is determined or suspected by GetTheJobDoneRight, in its sole discretion, that you are misusing or attempting to misuse or circumvent the GetTheJobDoneRight services or system, or are using or attempting to use them for any inappropriate, non-personal, or commercial purposes, including but not limited to activities such as hacking, infiltrating, fraud, advertising, jamming or spamming, GetTheJobDoneRight reserves the right, in its sole discretion, to immediately terminate your access without notice and to initiate without notice appropriate legal actions or proceedings to seek appropriate remedies and/or damages, including but not limited to lost revenue, repairs, legal fees, costs and expenses, and to seek injunctions or other equitable remedies. B. CONTRACTORS A Contractor who subscribes to GetTheJobDoneRight’s services acknowledges and agrees that his use of GetTheJobDoneRight’s services is for commercial or advertising purposes. You agree that all of the content and information posted on the GetTheJobDoneRight Website, including, but not limited to, Contractor profiles, screening information, feedback (including any feedback provided with respect to you and work done by you on behalf of any Homeowner) and archive summaries of completed jobs, is the sole and exclusive property of GetTheJobDoneRight, and that you have no right to reproduce, post, publish, or otherwise use such information other than for your use relating to a Homeowner’s service request. You agree to indemnify and hold GetTheJobDoneRight harmless from any claims brought against GetTheJobDoneRight based on or arising from your violation of the foregoing. All information about Homeowners is confidential and for your use relating to a Homeowner’s Service request only. CONTRACTOR PRESCREENING PROCEDURES AND DISCLAIMERS. GetTheJobDoneRight attempts to list all Contractors licensed or registered with the appropriate governmental authorities in the State or jurisdiction in which the Contractor does business. This is the only prescreening procedure which GetTheJobDoneRight will undertake with respect to Contractors who have not subscribed to our services. NOTE: Information regarding licensing or registration of Contractors may change or expire over time; while GetTheJobDoneRight attempts to maintain accurate and up-to-date information, we cannot guarantee that registration information is accurate. With respect to those Contractors who have subscribed to our services, GetTheJobDoneRight will also: (a) perform a check of the Better Business Bureau’s website to determine whether or not any complaints have been filed against a Contractor; and (b) attempt to verify that the Contractor carries liability insurance. GetTheJobDoneRight will display information regarding the results of its presecreening procedures by means of an icon located on the Contractor’s profile: The above procedure may change from time to time at the sole discretion of GetTheJobDoneRight. GetTheJobDoneRight believes that it uses commercially reasonable methods to check these matters but does not make any representations or warranties that any Contractor is appropriately licensed or registered. GetTheJobDoneRight does not represent or warrant that the information received from state or other government agencies or from third party sources is accurate, error free, or that it is up to date or updated at the time that GetTheJobDoneRight receives such information. Most agencies have periodic update cycles or schedules and this information may not be updated on a real-time basis by such agencies and third party sources. GetTheJobDoneRight recommends that, before working with a Contractor, you verify that the Contractor is licensed or registered with the appropriate governmental authorities. GetTheJobDoneRight also recommends that you independently verify that the Contractor carries appropriate liability insurance or is bonded, and is free of bankruptcies or civil or criminal legal judgments. Contractors Profiles: GetTheJobDone Right allows Contractors who have subscribed to GetTheJobDoneRight’s services to post profiles about themselves and their business on the GetTheJobDoneRight Website. GetTheJobDoneRight does not review or verify the information or representations set forth in those profiles, as they are self-reported by the Contractor. DISCLAIMER: GETTHEJOBDONERIGHT EXPRESSLY DISCLAIMS ANY AND ALL WARRANTIES, EXPRESS OR IMPLIED, RELATING TO THE PRESCREENING PROCESS, CRITERIA, PROCEDURES, OR INFORMATION OBTAINED OR PRESENTED IN THE PRESCREENING PROCESS OR DISCLOSURES, INCLUDING, BUT NOT LIMITED TO, ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR USE, OR THAT THE SCREENING OR VERIFICATION PROCEDURES OR STANDARDS ARE SUFFICIENT OR THAT THE INFORMATION RECEIVED IN THESE SCREENING OR VERIFICATION PROCEDURES IS ACCURATE, TIMELY OR ERROR FREE. 8. These Terms and Conditions will inure to the benefit of GetTheJobDoneRight’s successors, assigns and licensees. If any provision of these Terms and Conditions shall be deemed unlawful, void or unenforceable, for any reason, by any court of competent jurisdiction that provision shall be modified in order to make it enforceable, while maintaining the spirit of the provision. Alternatively, if modification is not possible, such provision shall be stricken and shall not affect the validity and enforceability of the remaining terms. The failure of GetTheJobDoneRight to exercise or enforce any right or provision of these Terms and Conditions shall not constitute a waiver of such right or provision. The section titles in theses Terms and Conditions are for convenience only and have no legal or contractual effect. These Terms and Conditions are governed by the laws of the State of Connecticut.
